A proposed law governing the capture of animals is being proposed by the Texas Parks and Wildlife Department personnel. The Texas Parks and Wildlife Department recommends updating TAC 65.907’s Special Get Authorization for White-tailed and Animal Deer.
The proposed new section would establish rules for landowners and their agents ‘ approval of white-tailed or mule deer when necessary to support or support the department’s efforts to treat chronic wasting disease ( CWD ).
House Bill 3065, which allows the taking of animals by those who are authorized by the office as part of a program or event that the executive producer designates as being conducted for the diagnosis, control, or protection of a disease in wildlife, was passed by the Texas Legislature during the most recent normal session. The proposed rule would establish a carefully controlled and strict regulatory procedure for allowing individuals without departmental control to photograph local deer for department-sponsored analysis and management projects. due to H. Just department employees or academics who engage in research-related activities may take for animals in violation of the restrictions if the consider was regulated by a period, time of day, bag limit, or other means established by the commission. The department has a unique challenge because of the rapid identification and removal of” trace deer” ( deer that at some point were in a deer breeding facility where CWD was later identified ( positive facility ) or that have become epidemiologically linked to a positive facility ) at locations that have received deer from deer breeding facilities. The sooner record deer can be removed from the environment and tested, the less likely it is that the deer, if they had contracted CWD, would have been able to infect more animals or produce infectious disease at the launch site. Additionally, such activities add to the department’s understanding of the nature of CWD, its transmission, progression, and presence in the environment. Therefore, there was no way for the department to authorize individuals not affiliated with the department to bring deer to aid the department in disease management and research if a release site has an epidemiological relationship to a positive facility at a time of year when hunting is not permitted. As part of broader sampling and monitoring efforts, the department may use this authority to conduct epidemiological investigations at locations that were n’t designated as breeding ground for breeder deer.
Recreational hunting and traditional wildlife management are not included in a special take authorization’s activities; instead, they are a part of the department’s management efforts to investigate and manage CWD. Therefore, the rules contain strict exceptions to any potential confusion regarding the purpose or intent of a special take authorization.
