On Thursday, the Texas Parks and Wildlife Commission adopted a rule restricting its use of eminent area.
The Texas Parks and Wildlife Department ( TPWD ) is prohibited from taking private property for park sites unless absolutely necessary, primarily property that has previously been set aside for public use as a park. This policy was adopted during the commission’s meeting in August.
According to Commission Chairman Arch” Beaver” Aplin III,” our commissioners chose to restrict TPWD’s use of eminent website to guarantee it will be used extremely lightly and only under particular circumstances” due to its significant possible impact on private landowners. ” The plan is clear: TPWD will not condemn homes, farms, or farms using eminent site.”
The Parks and Wildlife Code( section 21.103 ) gives TPWD the right to condemn park sites and pay the owner a fair market value settlement.
