According to the Supreme Court of the United States ‘ (SCOTUS) decision to decline the Biden administration’s appeal, Texas emergency room ( ER ) doctors are not required to perform abortions under the Emergency Medical Treatment and Labor Act ( EMTALA ).
The U.S. Court of Appeals for the 5th Circuit’s choice to ignore the Biden administration’s arguments supports a district court’s permanent order of a federal law mandating the provision of abortions by Texas hospital emergency room physicians under EMTALA.
