Critical emergency and safety warning
INACCURATE, INCOMPLETE, OUTDATED OR MISSING INFORMATION CAN RESULT IN SERIOUS INJURY OR DEATH. HILL COUNTRY POST IS NOT AN EMERGENCY RESPONSE SERVICE OR A SUBSTITUTE FOR OFFICIAL ALERTS. DO NOT RELY ON THIS WEBSITE AS YOUR SOLE OR PRIMARY SOURCE FOR SAFETY DECISIONS. IN AN IMMEDIATE EMERGENCY, CALL 911. FOLLOW CURRENT INSTRUCTIONS FROM AUTHORIZED EMERGENCY OFFICIALS. DO NOT WAIT FOR A WEBSITE UPDATE, REPLY OR CONFIRMATION BEFORE TAKING NECESSARY EMERGENCY ACTION.
1 Purpose and scope
This Website Disclaimer and Electronic Acceptance Agreement (“Agreement”) applies to Hill Country Post at hillcountrypost.org and content distributed through its related pages, feeds, email notices, links and other publication channels (“Website”). “Hill Country Post,” “we,” “us” and “our” refer to the Website’s operator and publisher. “Content” includes advertisements, classified listings, business promotions, community information, public and legal notifications, public service announcements, and emergency and safety notices. This Agreement explains the limits of that information and, when affirmatively accepted, establishes the user’s agreement to its enforceable terms.
2 Third party content and apparent official sources
Content may be supplied by advertisers, businesses, members, publishers, government agencies, public safety authorities, utilities and other independent contributors. Hill Country Post intends to obtain public service, emergency and safety notices from sources it believes to be governmental or otherwise official and to reproduce information it believes to be accurate and current when obtained. Those beliefs are not a representation that every source has been authenticated or that every notice is correct, complete or still in effect.
Unless a specific verification process is expressly described for a particular item, publication does not mean Hill Country Post or its affiliates have independently authenticated the source, verified the underlying facts, inspected the affected location or confirmed the notice’s current status. Agency names, seals, logos, links and attribution do not themselves establish authenticity, government sponsorship or endorsement.
3 No guarantee of accuracy or availability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, COMPLETENESS, AUTHENTICITY, CURRENCY, RELIABILITY, DELIVERY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON INFRINGEMENT. NO WARRANTY ARISES SOLELY FROM PUBLICATION, MODERATION, PAYMENT FOR AN ADVERTISEMENT OR IDENTIFICATION OF AN APPARENT OFFICIAL SOURCE.
4 Emergency and safety notices
Emergency and safety Content may address severe weather, flooding, wildfire, evacuations, road closures, water contamination, utility failures, public health, law enforcement activity or other hazards. Conditions and official instructions can change before a notice reaches this Website or before a user reads it. Errors may arise in the originating notice, third party transmission, automated feeds, summaries, translations, geographic targeting, timestamps, caching or display. A notice may be amended, cancelled or superseded without that change immediately appearing here.
Hill Country Post does not guarantee uninterrupted monitoring, real time publication, complete geographic coverage, delivery to any person or device, or removal of every outdated notice. Email, browser and other notifications can fail, be delayed, be filtered or be unavailable. A subscription does not establish an emergency monitoring or protective service.
THE ABSENCE OF A NOTICE, THE REMOVAL OF A NOTICE, AN EXPIRED TIMESTAMP, A FAILED ALERT OR SILENCE FROM THIS WEBSITE DOES NOT MEAN THAT A LOCATION IS SAFE OR THAT A HAZARD HAS ENDED. NO WEBSITE POST CONSTITUTES AN ALL CLEAR UNLESS IT ACCURATELY RELAYS A CURRENT ALL CLEAR FROM THE RESPONSIBLE AUTHORITY; USERS SHOULD CONFIRM THAT AUTHORITY’S CURRENT INSTRUCTIONS.
5 Official instructions and independent confirmation
Use current alerts and directions from the responsible emergency management office, fire or law enforcement agency, public health authority, utility or National Weather Service. Maintain access to official alert channels, including local alert subscriptions, Wireless Emergency Alerts and NOAA Weather Radio where applicable. Confirm the issuing authority, affected area, issue time, time zone, expiration and subsequent updates whenever circumstances safely permit.
A republished notice does not replace an official order. If a Website summary conflicts with current official instructions, follow the current official instructions. Do not delay evacuation, sheltering, contacting emergency services or other necessary protective action to verify this Website. Do not use the Website’s contact form, email address, comments or advertising submission process to request emergency assistance.
6 Public service and community notices
Public service information may concern closures, schedules, assistance programs, community events, utilities or other services. Users should confirm eligibility, dates, location, availability, contact information and requirements with the responsible organization before acting. Publication does not guarantee that a service remains available or that every applicable notice has been posted. Hill Country Post does not issue governmental orders or make eligibility determinations merely by republishing information.
7 General information and professional advice
Content provides general information and does not create a medical, legal, financial, engineering, emergency response or other professional relationship with Hill Country Post. Obtain advice from appropriately qualified professionals for individual circumstances. This provision does not diminish the importance of following lawful, current official emergency directions.
8 Advertising business listings and transactions
Advertisers and contributors are responsible for their descriptions, prices, availability, qualifications, licenses, promises and contact details. Publication or payment does not establish endorsement, vetting, certification or a guarantee by Hill Country Post. Users should independently confirm business legitimacy, credentials, product or service suitability and transaction terms.
Unless expressly agreed in a separate written contract, Hill Country Post is not a party to transactions between advertisers and users and does not guarantee payment, delivery, workmanship, performance, refunds or resolution of disputes. Sponsored or paid placement does not transform an advertiser’s statements into Hill Country Post warranties.
9 Legal and other required notices
Legal notices may include estate, court, foreclosure, auction, procurement, government meeting, regulatory and other announcements supplied by third parties. Hill Country Post does not provide legal advice or determine that a notice is legally sufficient. Publication does not by itself establish valid service of process, statutory publication compliance, an effective filing, a binding deadline, a legal right or the truth of an allegation.
The submitting party must determine the applicable publication medium, qualifications, wording, timing, frequency, circulation, geographic coverage, affidavits and proof requirements. Unless separately agreed in writing and supported by applicable law, Hill Country Post does not represent that online placement satisfies a requirement for publication in a qualified newspaper or another specified medium. Readers should confirm legal deadlines and obligations with the responsible court, agency or legal counsel. Nothing in this Agreement disclaims a publication duty imposed by law or expressly undertaken in a controlling written contract.
10 Contributor responsibilities and source attribution
Contributors must have authority and necessary rights to submit Content; provide accurate and complete information to the best of their knowledge; identify the original source and relevant dates for official notices; and promptly report known material errors, cancellations or superseding instructions. Contributors must not impersonate officials or knowingly submit fraudulent, misleading, defamatory, unlawful or infringing material. Submission and publication remain subject to applicable Website policies.
11 External sources corrections and archived material
Links, embedded material, excerpts and automated feeds may lead to independently operated services whose content and availability Hill Country Post does not control. Inclusion does not warrant their security, accuracy or continued availability. Summaries and translations may omit details; consult the issuing source’s current complete notice.
Hill Country Post may correct, label, restrict or remove Content, but does not promise that every error will be detected or corrected within a specified time. Archived posts may describe past conditions and are not current safety guidance. Report suspected errors through the Website’s published contact method and, for urgent hazards, contact the responsible authority directly. Error reports to the Website are not emergency requests.
12 Risk acknowledgment
Users acknowledge that reliance on inaccurate, outdated, incomplete, misattributed, delayed or undelivered Content can lead to financial loss, property damage, serious bodily injury or death. Users who affirmatively accept this Agreement agree to exercise reasonable judgment, use official emergency sources and independently evaluate third party information when circumstances safely permit. This acknowledgment does not shift a duty or risk that applicable law prohibits shifting.
13 Limitation of liability and express ordinary negligence release
IMPORTANT LIABILITY TERMS FOR USERS WHO AFFIRMATIVELY ACCEPT THIS AGREEMENT
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HILL COUNTRY POST AND ITS OPERATOR, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS AND AFFILIATES (“PROTECTED PARTIES”) SHALL NOT BE LIABLE FOR CLAIMS OR LOSSES ARISING FROM THIRD PARTY CONTENT, ADVERTISING, LEGAL OR PUBLIC NOTICES, EMERGENCY OR SAFETY NOTICES, OR ERRORS, OMISSIONS, DELAYS, FAILED DELIVERY OR RELIANCE ON SUCH CONTENT, TO THE EXTENT THAT LIABILITY MAY LAWFULLY BE EXCLUDED.
TO THE SAME LAWFUL EXTENT, AN AFFIRMATIVELY ACCEPTING USER EXPRESSLY RELEASES THE PROTECTED PARTIES FROM CLAIMS ARISING FROM THAT USER’S RELIANCE ON, OR FAILURE TO RECEIVE, SUCH CONTENT, INCLUDING CLAIMS FOR PROPERTY DAMAGE, PERSONAL INJURY OR DEATH CAUSED IN WHOLE OR IN PART BY A PROTECTED PARTY’S OWN ORDINARY NEGLIGENCE IN OBTAINING, SELECTING, REPRODUCING, SUMMARIZING, TRANSMITTING, DISPLAYING, UPDATING OR FAILING TO UPDATE THAT CONTENT. THIS PROVISION EXPRESSLY ADDRESSES THE PROTECTED PARTIES’ OWN ORDINARY NEGLIGENCE, INCLUDING SOLE OR CONCURRENT ORDINARY NEGLIGENCE, ONLY TO THE EXTENT A VALID RELEASE OF SUCH CLAIMS IS PERMITTED BY LAW.
WHERE LAWFULLY PERMITTED, THE PROTECTED PARTIES ALSO DISCLAIM LIABILITY FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, LOST OPPORTUNITIES OR DATA LOSS ARISING FROM SUCH CONTENT. THESE PROVISIONS DO NOT RELEASE OR LIMIT LIABILITY FOR GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, VIOLATIONS OF NON WAIVABLE STATUTORY RIGHTS OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE RELEASED OR LIMITED. THEY DO NOT PURPORT TO BIND NON ACCEPTING PERSONS OR EXTINGUISH ANOTHER PERSON’S INDEPENDENT NON WAIVABLE CLAIM.
14 Affirmative electronic acceptance
An agreement to contractual terms occurs through the designated unchecked acknowledgment controls and acceptance action, with reasonable access to the complete Agreement before acceptance. Mere browsing, silence or a prechecked box is not the designated affirmative acceptance process. Public safety information remains available without requiring registration or contractual acceptance. The Website may require acceptance during registration and before a first advertisement, business listing or public or legal notice submission.
A user accepting on behalf of a business or organization represents authority to agree for that entity. Acceptance records may include user or submitting party identifier, acceptance type, server timestamp, version, action and related submission identifier. Records are handled under applicable law and the Privacy Policy. Electronic consent does not make an otherwise unenforceable term enforceable.
15 Amendments governing law and other terms
Changes apply prospectively with revised version and effective date; renewed affirmative acceptance will be obtained where required or appropriate for material changes. Texas law governs to the extent permitted, subject to controlling federal law and non waivable protections. Invalid provisions are severed to the extent permitted without enlarging remaining releases. This Agreement supplements the Terms of Use, Privacy Policy and advertising or publication contracts; it does not erase duties imposed by law or a more specific controlling written agreement.
