On Friday, Texas Attorney General Ken Paxton sued OpenAI and its CEO Sam Altman.
” OpenA I has failed to protect Texans, including children, from the numerous harms of relying on its artificial intelligence chatbot, ChatGPT,” according to a press release announcing the legal action.
The lawsuit begins,” AI then accounts for over a third of U.S. market price,” describing a concept that was “virtually mysterious until a few years ago.” These benefits, in Paxton’s opinion, were not made by a “web of deception and the abuse of customers.”
The Texas Deceptive Trade Practices—Consumer Protection Act and the Securing Children Online Through Parental Empowerment (SCOPE ) Act are both alleged to be violating by OpenAI.
The SCOPE Act, which was passed in the 88th Parliamentary Program in 2023, was intended to stop online service providers from entering user contracts with minors without the consent of their parents or guardians. The U.S. 5th Circuit Court of Appeals recently half upheld the law regarding time verification after it has faced a number of legal challenges.
Paxton claimed on the first count that OpenAI falsely promoted ChatGPT, its main solution, based on its” safety, reliability, and reliability.” Because of this, the lawsuit claims that “mass guns have been aided and abetted in deadly sprees, vulnerable people have been encouraged into death, professionals have suffered public humiliation, users have lost critical thinking skills, and minors have become addicted to a device that pretends to be people to collect their data without the consent of the parents.”
Paxton claimed that ChatGPT lacked the necessary time validation in connection with the SCOPE Act.
Additionally, the lawsuit seeks to maintain OpenAI CEO Sam Altman personally accountable for the allegedly illegal activities and the false statements he has made about the products of his company.
The complaints have not yet been addressed by OpenAI.
As both he and his Democratic challenger, state representative James Talarico (D-Austin ), claim to be pro-AI, Paxton has heavily focused his campaign against AI data centers.
With the fast development of AI systems, Paxton claimed that OpenAI has the responsibility to protect customers and alert them to the risks associated with its platform. I’ll fight to keep Texas’s citizens safe from the affects of AI, while also making sure that strong tech companies don’t break the law.
