Since the Supreme Court granted sports betting to states in the United States in 2018, there has been a rise in online gaming, raising questions about gambling addiction and calls for stricter consumer protections. Online casinos such as DraftKings and FanDuel have touted “responsible game” features as proof that they are taking appropriate steps to protect consumers from spiraling out of control.
Reporter Jake Pearson tested these protections. He was bankrolled by ProPublica, and he spent ten weeks attempting to mimic the betting patterns of a troubled casino, speaking with a section of habit specialists, recovering gambling addicts, and professional sports bettors for guidance.
He found that the security features were overpowered by the app’s product design and offers that pushed him to continue gambling.
You can read more about Pearson’s whole journey here. Five things can be learned from his research.
1. There are numerous sports betting sites. The sector depends on very effective losers.
Today, almost a quarter of all Americans, and half of people ages 18 to 49, say they have an active casino account, according to the Siena Research Institute. However, that rapid expansion has had its consequences: About a quarter of lively casino account holders surveyed by the business this year said they had lost far enough money to struggle to meet their financial obligations.
Gamblers who often lose are the ones sportsbooks are most interested in, according to Matthew Gaskell, a European counselor and expert on gambling addiction. Gaskell noted that a relatively small number of effective losers accounts for a substantial amount of casinos ‘ profits.
According to a study conducted in Connecticut in 2024, 51 % of sports betting revenues came from Connecticut’s problem gambling.

Lotto claims that its ethical game system offers sufficient safeguards to stop customers from outgrowing their grip. According to Lori Kalani, DraftKings ‘ chief responsible gaming officer,” I think as a business, as an industry, we’re doing a good job of educating people, raising awareness, making tools and resources available, and monitoring accounts,” she told Pearson.
But politicians aren’t so positive. Then, Colorado and Massachusetts lawmakers are proposing stricter customer privileges.
2. DraftKings has adopted responsible gambling resources. They demand that people consent, which lessens their success.
In-app notifications that encourage gamblers to take a break after losing income and “time reminders” that indicate how long people have been using the application are among Lotto ‘ responsible gambling measures. The software also features a responsible gaming center that allows users to set a budget, track their spending or settle into tools like those that allow them to reduce the amount of time and money they spend in a 24-hour period or enact more severe restrictions such as a multiday” great off”.
However, a majority of consumers of this system must be able to choose to use the equipment, which is, according to experts, challenging for someone with a gambling addiction.
Lotto advised Pearson to actively close an account if a customer’s conduct raises also some red flags. Yet it doesn’t specify how often this really happens.

In order to determine when and if the agency’s safeguards may prevent a problem gambler, Pearson’s experiment mimicked the behavior of the gambler. The first in-app responsible gambling quick Pearson received came more than a week after he began gambling on the NBA playoffs, when he’d now lost about what a minimum-wage worker in New York City earns in a month. He was informed that he had made$ 2,500 or more in debris, and that he could go to our Responsible Gaming Center at any time to set limits on your gambling activity and access resources for safer play.
However, Pearson’s foolish betting didn’t cause the notice to appear in the app. It was officially required. Legislators in New York required the apps to notify users when they had made$ 2,500 in total deposits when the state legalized mobile sports betting in 2023. The pop-up offered Pearson two choices: to set limitations or to say” I understand.” He clicked the latter and was back in action.
Our panel of experts observed that Pearson’s following instructions from the software followed the same pattern as he did red flag after dark symbol, according to our panel of experts.
Millions of people have visited DraftKings ‘ responsible gambling facility, according to the little info that is made available to the public, suggesting only a small percentage of people will use these tools. Just over 8 % of active DraftKings users in Massachusetts were using them as of April, a company official told state regulators this summer. The standard added that the trend was picking up.
Kalani claims that her 51-person group personally checks user accounts that might be at risk of having a problem gambling. But even after Pearson deposited$ 21, 600 into his account in less than eight weeks and exhibited just about every sign of compulsive gambling, he didn’t file for a regular assessment under the company’s requirements.
3. The design of online sports betting sites can encourage more money to be won.
Online gambling companies have created sophisticated technology products designed to squeeze maximum engagement out of users, just as social media companies like Meta did years earlier with users of Facebook and Instagram, according to Darragh McGee, a researcher at the University of Bath.
In fact, Pearson discovered that the app’s design encouraged him to keep betting.

As he increased his gambling, he noticed that the app’s quick-tap deposit buttons increased automatically, making it even simpler to mindlessly deposit large sums into his DraftKings account. And while DraftKings ‘ safety warnings were sporadic, he was getting up to six push notifications a day notifying him of rewards and betting opportunities.
DraftKings informed Pearson that it sent him 32 responsible gambling instructions over ten weeks of gambling, including emails that each customer receives from DraftKings. Pearson recorded his betting data in in-app notifications for 14 of his 71 days of use of the app.
4. Rewards can also help to spur more wagers on users.
DraftKings, like many other sportsbooks, also offers VIP programs that give users benefits like free bets and concert tickets. After Pearson lost$ 1, 800 betting on basketball in one night, chasing his losses with increasingly long-shot bets, he was invited to audition to become a DraftKings VIP. After only three weeks and$ 5,800 in app deposits, Pearson was formally accepted into DraftKings ‘ VIP program, which gave him a personal concierge.
That VIP host informed Pearson that he would be “keeping an eye out for opportunities and benefits tailored specifically” to his account, as well as “reminders about Responsible Gaming.” Company representatives offer VIPs special incentives to continue gambling, such as “bonus bets” ( free one-time bets using house money ) and “deposit matches” ( extra house money called DK Dollars that come along with new deposits ).
The program, according to Pearson, rewarded riskier bets. Users accumulate credits needed to “advance” to higher tiers that offer better perks the more money they spend on long-odds wagers.
Less than a week after Pearson opted into a three-day” cool-off” period— after losing several thousand dollars betting on tennis — Pearson contacted his VIP representative, who helped facilitate his largest deposit match to date: juicing a$ 5, 000 deposit with an extra$ 1, 250 in free DK Dollars.
5. Online gamblers are left to operate their own rules. Experts say more limits are needed.
While online gambling generates billions of dollars in tax revenue, research shows that states that legalized gambling have a rising rate of gambling disorder diagnoses.
Sportsbooks like DraftKings are required to submit a “problem-gaming plan” to the state regulator in New York, but the law forbids the businesses to provide specifics. The plan must include, among other things, procedures” for identifying users with suspected or known problem-gaming behavior” and for “providing information to users concerning problem-gaming identification and resources”. Because these plans are not made available to the general public, the precise details are unclear. ( A DraftKings representative declined to provide a copy, and Pearson’s request for it is being reviewed in light of the state’s open records law with the gaming commission. )
Other countries have already taken aggressive steps to regulate online sportsbooks ‘ marketing practices and advertisements. However, the industry has actively opposed proposed changes on the federal and state levels in the United States, creating a political action committee with$ 41 million to influence elections this year.
One of the experts we spoke with, Rob Minnick, a recovering gambling addict, disagreed that a publicly traded company with a desire to increase revenue shouldn’t be given the task of providing the framework for consumer protection.
DraftKings told Pearson that all 5, 000-plus of its employees are trained on responsible gaming every year and that it’s” not a side initiative. It is fundamental to DraftKings ‘ long-term sustainability and is embedded in our business.
Kalani told Pearson,” The system worked the way it was supposed to.”
Critics say that’s the problem.
