The Texas Supreme Court reversed a lower court’s injunction regarding the legality of hemp-derived delta-8 THC, stating that the order “transgresses the separation of powers.”
The Supreme Court ruled that the state is permitted to treat manufactured delta-8 hemp products as Schedule I controlled substances, which overturned an injunction previously secured by the hemp company Hometown Hero, along with other hemp industry leaders, in Travis County district court.
